Estate Planning

The most often question I get asked when it comes to estate planning is, “Do I need an estate plan?” The answer is that you already have one! Every person already has an estate plan, the one imposed on you by the state of Missouri. The important question is would you rather decide or would you rather have the state of Missouri decide:

·      Who would take care of children in case of your death?

·      How your possessions are distributed when you pass away.

·      Who could make medical decisions in case you are not able to?

Many people, including attorneys, often overlook the most important part of proper estate planning. While it is helpful for your family to have some guidance on what your last wishes are, the more important issue is planning for your care during your lifetime. A properly executed trust, advance health care directive, and a durable power of attorney can allow you to decide who could make decisions on your behalf if you become unable to do so yourself. This is something everyone can, and should plan to address while they are able to do so.

The hiring of a lawyer is an important decision that should not be based solely upon advertisements.
