Do I Need an Estate Plan?

The most often question I get asked when it comes to estate planning is, “Do I need an estate plan?” The answer is that you already have one! Every person already has an estate plan, the one imposed on you by the state of Missouri. The important question is would you rather decide what happens to your assets or would you rather have the state of Missouri decide?

Many people, including attorneys, often overlook the most important part of proper estate planning. While it is helpful for your family to have some guidance on what your last wishes are, the more important issue is planning for your care during your lifetime. A properly executed trust, advance health care directive, and a durable power of attorney can allow you to decide who could make decisions on your behalf if you become unable to do so yourself. This is something everyone can and should plan to address while they are able to do so.
