Hurt in an accident?
An injury can upend your health, your work and your finances, while the insurance company works to pay as little as possible. Call us first. We’ll listen to what happened, explain your options and deadlines under Missouri law, and connect you with a personal injury firm suited to your case. The consultation is free, in English or Spanish.
Injury cases we can help with
- Car, truck and motorcycle accidents
- Pedestrian and bicycle accidents
- Rideshare accidents
- Slip-and-fall and other injuries on someone else’s property
- Dog bites
- Wrongful death
What a claim can include
Missouri law lets an injured person recover for:
- Medical bills, now and in the future
- Lost wages and lost earning ability
- Pain and suffering
- Damage to your vehicle and other property
Missouri deadlines
In most Missouri personal injury cases, you have five years from the date of the injury to file a lawsuit (RSMo 516.120). Wrongful death claims generally must be filed within three years (RSMo 537.100). Claims for medical negligence, or against a city or other government body, can have much shorter deadlines and notice requirements. Evidence also fades with time, so call early.
If you were partly at fault
Missouri follows pure comparative fault. If you were partly responsible for the accident, you can still recover, but your award is reduced by your share of the fault.
What to do after an accident
- Get medical care, and follow your doctor’s instructions.
- Call the police, and get the report number.
- Take photos of the scene, the vehicles and your injuries, and get witnesses’ names and phone numbers.
- Notify your own insurance company, but talk to a lawyer before giving a recorded statement to the other driver’s insurer.
- Keep your medical bills and records, and a list of the work days you miss.
Fees
Personal injury firms usually work on a contingency fee: you pay no attorney fee unless they recover money for you, and the fee is an agreed percentage of the recovery. In some cases the firm handling your case may cover the case expenses. Otherwise, you may be responsible for court costs and case expenses, such as filing fees, medical record charges, deposition costs and expert fees, whether or not you recover anything. The handling firm’s written fee agreement will say which applies. If BlackRock Legal will share in the fee, that arrangement will be explained to you and confirmed in writing before your case begins.
