Sued over a debt?
A lawsuit from a credit card company, bank or debt buyer is not the end of the story. If you do not respond, the court can enter a default judgment, which can lead to garnishment of your wages and bank accounts.
When you respond, the company that sued you has to prove its case. It must show:
- That it owns the debt
- That the amount it claims is correct
- That it filed in time, since older debts may be past the statute of limitations
Debt collectors must also follow the federal Fair Debt Collection Practices Act. Violations can give you claims of your own.
We review the petition and the paperwork behind it, raise the defenses that apply, and negotiate or try the case.
Already have a judgment against you?
We can review whether the judgment was properly entered, whether exemptions protect some of your wages or property, and whether a settlement is possible.
